Terms & conditions - updated April 2011

1.       About us

1.1 This website is owned and operated by NJM Toms & Son,

2.       Making a contract with us

2.1 When you place an order with us, you are making an offer to buy goods. We will send you an email to confirm that we have received your order.

 

2.2 Once we have checked the price and availability of the goods, we will email you again to confirm that we accept your order, and that a contract has been made between us. This email will state that your order has been received and is being processed.

 

2.3 If the goods are not available, or a pricing mistake has been made, we will advise you of this as soon as possible, and ask if you wish to proceed with your order.

 

2.4 If the goods are not available, we may supply you with substitute goods. These will be of the same or greater value as your original order. If you decide not to accept the substitute goods, you may return them free of charge and request a refund.

3.       How to place an order

3.1 To enable you to order from our website you will first need to register with us.  To do this you must be over eighteen years of age.
3.2 All of the information that you supply must be correct and you should inform us as soon as practicable should any details change.


3.3 Once an order or account has been set up, confirmation of your details and a link to these terms and Conditions will be sent to you. You are advised to print a copy of this document for your records. Once you have completed registration you will be prompted to enter a password. As with all passwords, you are advised not to disclose this to others.

3.4 Select your products using the right-hand navigational menu headed "Products." To add an item to your basket, click "buy item", changing the quantity if required by typing in the appropriate box.

 

3.5 Where goods are priced by weight, these are a guide and the weight of your item could vary by up to 10%. For some items, you will need to specify a weight. These are in grams or kilos unless otherwise stated.

When you have selected your items, an orange box, "Your Basket," will appear on the left hand side of the screen. When you have made your final selection, please click on "Checkout."

 

3.6 You may alter or remove goods in your basket at any time. Please remember to click "Update basket" at the bottom of the checkout page if you do make any changes.

 

3.7 If you have a promotional code, please enter it in the relevant text box, using capital letters and no spacing.

 

3.8 Select your delivery date by clicking in the relevant box and using the pop-up calendar. Please note we do not normally deliver Mondays and weekends. Click "Submit Date" before clicking "Continue."

 

3.9 Enter the postcode of the DELIVERY address and click "Submit". Delivery charges will be automatically calculated and the final order total displayed. Click "Continue" to proceed with your order.

 

3.10 If you are a new customer, please register by providing a billing and delivery address and confirming that you have read and agree to our Terms & Conditions. Existing customers can login by using their email address and password.

 

3.11 Please ensure that you provide a telephone number with the delivery address for our couriers to use in the event of any delivery problems.

 

3.12 On clicking "Pay with SagePay" you will be redirected to our secure payment server. Please follow the on-screen instructions to submit your payment. If you experience any problems with the SagePay system, please make a note of any error messages and contact us on 01752 895533.

 

4.       Delivery 

4.1 We can deliver on Tuesday, Wednesday, Thursday or Friday (excluding bank holidays).  If your order contains chilled items, these will remain chilled for 36 hours from leaving us at 4.30pm on the overnight service.  Your boxes can be delivered to work, a shady, dry place, to a neighbour or to you in person if you are home. 


4.2 We are able to provide local deliveries on  Mondays, Tuesdays, Wednesdays, Thursdays & Fridays.


4.3 Please place your orders at least 2 days before your required delivery date. For example if you would like a delivery on Friday, please order by the Wednesday. After this, we will try our best to fulfill your order but cannot guarantee delivery on your requested date.

5.       Delivery Costs*

 

5.1 National - £8.00
Local - £5.00 (within the PL21 postcode, delivery is free of charge)
Collection - Free

 

*Excludes Scottish Highlands, off shore and overseas deliveries. Email for a quote.  TLFC reserves the right to advise of additional charges on over 15kg for orders less than £100.

Local deliveries are those within the South Hams - A38 corridor (Plymouth to Ashburton/Bovey Tracey), Totnes (& surrounds), Kingsbridge (to Frogmore & Marlborough), north to Horrabridge.

 

5.2 Local deliveries are also available on Mondays and weekends for orders over £100. Please call or email us for more information.

 

5.3 You may collect your order any time between 12pm and 4.30pm at our Farm Shop, Countryman's Choice at Ivybridge.

 

5.4 If your delivery appears damaged when delivered please state "box damaged and goods not inspected" when you sign.   

 

6.       Cancellation and returns

6.1 You can cancel your contract at any time up to 7 working days after the date of delivery. To do this, please email or write to us. You do not need to give any reason for cancellation, but a brief explanation will help us to improve the service we offer to customers in the future.

 

6.2 If you cancel, you must return the goods to us at your own expense. You must ensure that the goods are adequately packaged to protect against damage.

 

6.3 If you fail to return the goods, we will collect them, and we will charge you the direct cost of collection.

 

6.4 If you fail to take reasonable care of the goods before they are returned to us, and this results in damage or deterioration, we will charge you for the reduction in value.

 

6.5 Unfortunately we cannot accept returns on perishable items unless the goods are faulty or misdescribed.

 

6.6 This cancellation policy does not affect your legal rights - for example if goods are faulty or misdescribed.

 

7.       Faulty Goods

 

7.1 If there is a problem with the goods, please contact us as soon as possible. We will deal with the matter in accordance with your legal rights.

 

7.2 Faulty, spoiled or unfit goods will always be fully refunded.

 

7.3 We aim to respond to all queries and complaints within three working days. A record of your complaint will be opened, and closed when you feel it has been resolved to your satisfaction.

8.       Changes to these terms

8.1 These terms were lasted updated by K. L. Toms on 20th April 2011. Previous versions of our standard terms and conditions can be viewed here.

8.2 These terms apply to your order. We may change our terms and conditions at any time, so please do not assume that the same terms will apply to future orders.
